🏗️ SHOULD GOVERNMENT MONEY BE HELPING DEVELOPERS B 🏗️ SHOULD GOVERNMENT MONEY BE HELPING DEVELOPERS BUILD MORE HOMES IN TORONTO?

Toronto has a housing affordability problem — but we may also be heading toward a serious housing construction problem.

With condo projects being delayed, construction costs remaining high, and financing becoming more difficult, governments are stepping in with:

🏢 Low-cost construction loans
💰 Development charge reductions
🏗️ Housing incentives
🏘️ Public land and affordable housing programs

But will any of this actually make Toronto housing more affordable?

Or are taxpayers simply helping developers protect their profits?

In my latest blog, I look at both sides of the argument and explain why the bigger concern may be what happens 3–5 years from now if today's stalled projects never get built.

Toronto can have a softer real estate market today and still be creating another housing shortage for the future.

🏠 Buying a home in Toronto? The purchase price is 🏠 Buying a home in Toronto? The purchase price is not the only number that matters.

Toronto buyers generally pay two land transfer taxes:

1️⃣ Ontario Land Transfer Tax
2️⃣ Toronto Municipal Land Transfer Tax

On a $1 million Toronto home, the combined land transfer taxes can be approximately $32,950 before rebates.

Eligible first-time home buyers may qualify for:

✅ Up to $4,000 from Ontario
✅ Up to $4,475 from the City of Toronto
✅ Up to $8,475 in combined rebates

But be careful: previous ownership of a home anywhere in the world—including certain inherited, trust or nominal ownership interests—may affect your eligibility.

Our latest blog explains Toronto land transfer tax rates for 2026, first-time buyer rebates, foreign-buyer taxes and the other closing costs purchasers should budget for.

Before submitting an offer, make sure you understand the true cost of buying a home in Toronto.

Old mortgages can cause big problems. 🏡⚠️ Just be Old mortgages can cause big problems. 🏡⚠️

Just because a mortgage was paid off does not always mean it was properly discharged from title.

That can create serious issues when you are trying to sell, refinance, or deal with an inherited property.

A title search can uncover problems like:

• old undischarged mortgages
• liens
• title defects
• other unexpected registrations

The good news? These issues can often be dealt with — but it is much better to find them early rather than right before closing.

If you are buying, selling, refinancing, or dealing with an estate property in Toronto or the GTA, getting legal advice early can save you time, money, and stress.

📞 Contact Capulli Law LLP if you need help with title issues, closings, or real estate transactions.

🏡 Should You Be a Guarantor for Your Child? With 🏡 Should You Be a Guarantor for Your Child?

With home prices across Toronto and the GTA remaining high, more parents are being asked to guarantee their child's mortgage.

But before you sign, ask yourself:

❓ Are you becoming an owner of the property—or just guaranteeing the mortgage?

Many parents don't realize there's a major legal difference.

If you're not on title, you may still be responsible for the mortgage if your child defaults, but you may have no ownership interest in the home.

If you are on title, you could be taking on additional legal, financial, estate planning, and family law implications that deserve careful consideration.

Helping your child purchase their first home is an incredible gift—but it's important to understand exactly what you're signing before committing.

In our latest blog, we explain:
✔️ The difference between a guarantor on title and one who isn't
✔️ The risks every parent should know
✔️ Why Independent Legal Advice is often required
✔️ Questions you should ask before signing any mortgage documents

🏗️ Buying Pre-Construction in Toronto? Look at t 🏗️ Buying Pre-Construction in Toronto?

Look at the Drawings FIRST.

Most buyers fall in love with the model suite and glossy brochures.

But the real truth about your condo purchase is in the architectural drawings.

And if you don’t review them carefully, it can cost you tens of thousands of dollars.

Here are common issues hidden in condo drawings that buyers miss:

📐 Unit size changes
Even small square-foot reductions can impact value and resale.

🪟 Window placements & blocked views
Future buildings, mechanical structures, or design changes can alter what you thought you were buying.

🧱 Bulkheads & dropped ceilings
These often appear in the drawings but not in marketing materials.

🚗 Parking & locker location
Not all spaces are equal — pillars, tight clearances, and distance from elevators matter.

🏢 Balcony differences
Exclusive use vs common element and size changes can affect usability and value.

The problem?

Once the condo closes, your ability to challenge these issues is extremely limited.

That’s why reviewing the builder agreement AND the drawings is critical.

⚖️ A proper legal review can catch problems before it’s too late.

Buying a Toronto condo resale?
If you don’t check for a Section 98 Agreement, you could be inheriting illegal renovations — and the bill.

Yes, your bill.

If the unit has:
❌ An enclosed balcony
❌ New flooring
❌ Plumbing or electrical changes
❌ Walls moved or layout altered

…and there’s no registered Section 98 Agreement, the condo corporation can:

⚠️ Force you to remove renovations
⚠️ Deny insurance coverage
⚠️ Charge you repair + legal costs
⚠️ Enforce compliance years after closing

“It was approved years ago” means nothing without paperwork on title.

📖 I just published a blog breaking this down, including:
✔ How buyers get burned
✔ What lawyers actually look for
✔ A condo buyer checklist you should use before waiving conditions

🚨 REAL ESTATE PSA – WHAT YOU’RE SEEING HERE 🚨 Thi 🚨 REAL ESTATE PSA – WHAT YOU’RE SEEING HERE 🚨

This article highlights a major shift in the Canadian new-build market.

Some developers are now offering refunds to pre-construction buyers if home prices drop before closing.

This is being offered to counter slow sales, falling prices, and buyer hesitation, especially in Ontario’s GTA market.

💬 Question for buyers and investors:

Do you think price-drop protection like this will spur more purchases, or are buyers still waiting on the sidelines?
