ATTENTION: If you live in Toronto, Ottawa or Hamil ATTENTION: If you live in Toronto, Ottawa or Hamilton YOU MUST SUBMIT YOUR VACANT HOME TAX DECLARATION BY APRIL 30TH!

As of 2025, the following cities in Ontario have implemented a Vacant Home Tax (VHT) or similar vacancy tax programs:

1. Toronto
•	Name: Vacant Home Tax
•	Rate: 1% of the property's Current Value Assessment (CVA) for the first year of vacancy; increases to 3% for subsequent years.
•	Effective Since: 2023
•	Details: Applies if a residential property is vacant for more than 6 months in a calendar year.
 
2. Ottawa
•	Name: Vacant Unit Tax (VUT)
•	Rate: 1% of the property's assessed value.
•	Effective Since: 2023
•	Details: Applies to residential properties vacant for more than 184 days in a year.
 
3. Hamilton
•	Name: Vacant Home Tax
•	Rate: 1% of the property’s assessed value.
•	Effective Since: 2024
•	Details: Targets properties vacant for more than 6 months in a calendar year. Hamilton followed Toronto and Ottawa in adopting this measure.
 
Cities Considering or Studying a Vacant Home Tax:
These municipalities have discussed or are studying the feasibility of introducing a VHT but have not yet implemented it as of 2025:
•	Mississauga
•	Brampton
•	Kingston
•	Niagara Region
•	London
These areas are monitoring the impact of vacancy taxes in Toronto, Ottawa, and Hamilton before making decisions.
 
It's important to remember that:
•	Annual Declarations are mandatory in cities with a VHT, even if the property is occupied.
•	There are exemptions (e.g., death of owner, major renovations, hospitalization).
•	Penalties apply for failing to declare or false declarations.

At Capulli Law, we are always intrigued by laws in At Capulli Law, we are always intrigued by laws in other Jurisdictions, Such as the Augusta Rule in the USA!

The Augusta Rule (also known as Section 280A(g) of the Internal Revenue Code in the United States) is a tax provision that allows homeowners to rent out their home for up to 14 days per year without having to report the rental income to the IRS—meaning that the income is completely tax-free.

Origin:

It’s called the “Augusta Rule” because it was originally used by residents of Augusta, Georgia, who rented out their homes to visitors during the Masters golf tournament each year. Congress codified it to allow people to rent out their homes for short periods without the burden of taxation and regulation.

Key Features:

You can rent out your primary residence or a vacation home for 14 days or fewer per year.

The income is not reportable or taxable—it doesn’t need to be included on your tax return.

You cannot deduct any related expenses (like cleaning, repairs, etc.) during the rental period.

If you rent it for more than 14 days, the income becomes fully taxable and must be reported.

Example:

A homeowner in Augusta rents out their house for 10 days during the Masters for $3,000 per night, earning $30,000. Since it's rented for 14 days or less, that entire $30,000 is tax-free under the Augusta Rule.

Business Use:

Some business owners use this rule creatively. For example, a business might "rent" the owner’s home for meetings or events and deduct the expense on the business’s taxes, while the homeowner receives the income tax-free—if it meets the IRS's fair market rental guidelines and is within the 14-day limit.
