Careless Driving & Stunt Driving under the Highway Traffic Act
Careless driving and stunt driving are prosecuted under the Highway Traffic Act (HTA). As a result they are not criminal charges, however, being found guilty of either careless driving or stunt driving can have a number of harsh consequences. These consequences could include increased insurance premiums, vehicle impoundment, significant fines and even jail time.
Careless Driving
Careless driving is found in Section 130 of the Highway Traffic Act. Section 130 states: Every person is guilty of the offence of driving carelessly who drives a vehicle or street car on a highway without due care and attention or without reasonable consideration for other persons using the highway and on conviction is liable to a fine of not less than $400 and not more than $2,000 or to imprisonment for a term of not more than six months, or to both, and in addition his or her licence or permit may be suspended for a period of not more than two years.
Stunt Driving
Section 172(1) of the Highway Traffic Act creates an offence for driving a motor vehicle in a race or contest, while performing a stunt, or on a bet or wager. Section 172(1) explains that “stunts” include exceeding the posted speed limit by more than 50 kilometers per hour. Upon a conviction for racing or stunt driving, he/she risks a fine of up to $10,000, a maximum of 6 months in jail, and a maximum two-year license suspension for a first offence. There is also a mandatory immediate vehicle impoundment and a 7-day license suspension under Section 172(6).
